Justice in Death---Chapter 16

They were snacking on vending machine food when Eve’s computer let out an alarm. Eve had her legs propped up on Roarke’s lap while they were talking and snacking. She slid them off his lap and practically ran the few inches to her computer screen. Eve had a hard copy printed off for herself and had one sent to Peabody. Eve studied the man’s face, which was now in color. Along with a driver’s license photo was the man’s vital stats.

   “Kelsey Boone,” Roarke read over her shoulder. “It doesn’t sound familiar to me.”

   “It wouldn’t. We hadn’t met yet,” Eve said. The face along with the name was vague. There was an address. Eve hit her link to contact Peabody when the Detective came through the door.

   “I sent the information to Feeney and McNab. They’re going through the digital notebooks to find Kelsey Boone’s name in the court files. We have his address,” Peabody reminded her. “Can we get a warrant?”

    Eve already had her link out. “It’s not a matter of can, Peabody, but when will we get the warrant.” She was contacting Reo as they spoke. When the blonde’s face came on the screen, Eve saw the weariness in her face. She didn’t know if Reo had been falling in love with Costa, but if the thought of losing Roarke made her sick, then Eve didn’t know what Reo was going through. Unfortunately, she didn’t have time to think about that. She wanted Kelsey Boone.

   “His name is Kelsey Boone,” Eve said immediately upon seeing Reo’s face in her screen. “We have an address. I’ll send you his vitals. Can you get us a warrant for his place?”

    “I’ll call you when I have it,” Reo was the one to end transmission.

   “What now, Lieutenant?” Roarke asked from the corner of his office. Eve forgot he was in there and now he was giving her that cocky smile.

    “We find out why Kelsey Boone killed two people and tried to kill me.” Eve took the hard copy of Boone’s face and vitals with her to see Feeney.

   Ryan Feeney was waiting for them when the three showed up in his department. He was sitting at McNab’s desk with McNab standing over him. He waved Eve and the others over as soon as they walked through the door.

   Eve saw the opened packet of nuts and the crumpled bags in the receptacle next to McNab’s desk. Feeney was going through nuts like an alcoholic through liquor. It would have worried her if she didn’t know that the nuts couldn’t hurt him like the alcohol could.

    “I put the cases we earmarked together on one disc and did a search for Kelsey Boone’s name. His was one of the cases we pulled for further review.” He clicked on the screen and brought up the file. “Do you remember Daniel Boone, kid?”

    Eve grimaced. “I wasn’t very good in history class, Feeney. Who was he again?”

    Feeney grinned. “Not that Daniel Boone, kid. This Daniel Boone.” He brought up the picture of a man in his twenties with a shaved head and piercing blue eyes. “Judge Marcus presided over the case that then Assistant Prosecuting Attorney Andrew Costa prosecuted. Mr. Boone’s lawyer was Alex Mahoney.” Feeney looked at Eve. “From the date of the trial, you were a few weeks away from passing your Lieutenant’s test. Dallas, Sergeant Eve testified that Daniel Boone admitted to killing his best friend when so called best friend attacked him. It was a clear case of self-defense, according to officer’s on scene and witness testimony.”

    “Accept Will didn’t think so,” It was all coming back to Eve like a flood of water rushing over her. “The jury came back with a verdict of not guilty reason of self-defense, but Will overturned the verdict.”

   Roarke’s eyebrows piqued. “I’ve never heard of a judge doing that.”

    Eve shook her head. “Neither had I. Will found him guilty of murder and sentenced him to prison for life.”

   Peabody wormed her way in between Eve and McNab to see what everyone else was seeing. “Why? It was clear the jury saw self-defense.”

   Eve nodded because she had seen it as well, but that’s where her friendship with Will Marcus began. A few days after the end of the trial, Will and Eve shared their first lunch together. It was then she learned that Will had seen something in Daniel Boone’s eyes that spoke something other than self-defense. He had gone on instinct and Eve told the group that.

    “So he sent an innocent man to prison for life,” Roarke summed up.

    Eve shook her head no, yet again. “Turns out, Will was right. Daniel Boone was guilty of murder.”

    “I don’t understand,” McNab said. He pulled his blonde ponytail over his shoulder to play with the orange ponytail holders keeping it back. They matched his orange pants.

    “Daniel Boone tried to kill an inmate in the prison as a way of asserting his strength to the other inmates. While he was stabbing him, Boone told the inmate that he was going to kill him just like he killed his best friend. Unfortunately for Boone, the inmate lived. He testified to what Boone said in order to get transferred to a minimum-security prison. Boone was given more time on his sentence for the attempted murder.” Eve looked back at the screen and the face of Daniel Boone. “What happened to Boone, Feeney?”

   Feeney turned back to his computer. His lean fingers tapped on the keyboard until another page came up on the screen. “Daniel Boone was killed in prison last month when an inmate got access to his cell. Looks like the inmate was a family member of the man that Boone tried to kill years ago.”

   “Justice,” Roarke whispered. “It comes in all forms.”

    Eve paced the room between McNab’s desk and Feeney’s office. “Daniel Boone is killed in prison and this sparks Kelsey Boone’s revenge. He kills Will because Will was the judge on the case. He kills Andrew Costa because at the time Costa was the Assistant Prosecuting Attorney on the case. He tried to kill me because I testified against him in court. Kelsey Boone sees the three of us as the ones that led his son to death. He’s getting justice for his son.”

   Feeney leaned back in McNab’s chair and put his hands behind his head. “You got it, kid.”

   Eve smiled at Feeney’s term of endearment for her. “Will you send everything to Commander Whitney, Feeney? Peabody and I are going to talk to the Commander. Reo’s getting us a warrant for Boone’s apartment. Once we have it, we have him.”

    Feeney did what Eve asked and then stood.  “I’m going back to my office. Tag me if there’s anything else I can do.”

   Eve nodded. “Let’s go see the Commander, Peabody. Roarke, we may be a while.”

    Roarke withdrew his PPA from his pocket as they walked out of the E room. “I told you I wasn’t going anywhere, Lieutenant. I’ll wait in the visitor’s area and get some work done.” Since he couldn’t be unescorted in Cop Central, Eve and Peabody dropped Roarke off in the dismal visitor’s area and then went to see Commander Whitney.

Pennie, as always your story is amazing and I am thoroughly enjoying it.......I , like Highnoon, have been catching up as I have not been able to be on as much as before........I try to check every day or two for new chapters on all stories, but don't always manage..........you are an amazing writer,..........

One minor flaw is that the law would have to really change to allow a judge to overturn a not guilty verdict. otherwise it's cool.
